Use and Consent

Please read these Website Terms and Conditions (hereinafter “Terms and Conditions”) carefully and in their entirety before using www.closetfairy.com (hereinafter “Website”).
These Terms and Conditions are entered into by and between Sara Mahdavi LLC, doing business as Closet Fairy (hereinafter “we,” “our,” “us”), and you.
As a user of our Website, you agree to these Terms and Conditions, and your use of our Website constitutes your acceptance of these terms to the extent permitted by applicable law.
This Website and our services are intended for adults aged 18 and older. If you are under 18, you may not book consultations, complete our forms, or otherwise submit personal information through the Website.

Privacy Policy
We respect your privacy. Please read our Privacy Policy, available through the Website footer, for information about how we collect, use, and handle personal information.

Website Information and Service Agreements
The Website provides information about Closet Fairy, personal styling, and our services. General styling information on the Website is not a substitute for recommendations tailored to you through a client engagement. Submitting an inquiry does not create a styling services agreement or guarantee availability.
Paid styling services are governed by a separate client agreement. Service scope, investment, payment schedules, cancellation provisions, and refund terms are addressed in that agreement or in the applicable booking terms. These Website Terms do not replace those terms or alter rights or obligations under a separate signed service agreement.

No Warranty or Liability
The information provided on our Website is believed accurate when made. However, we do not warrant or represent that such information is or will always be current, accurate, or complete. To the extent permitted by applicable law, we are not responsible for errors or omissions in Website content or materials requested through email.
Your use of our Website and its content is at your own discretion and risk. To the extent permitted by applicable law, Sara Mahdavi LLC assumes no liability for computer viruses or similar software code transmitted through the Website or in connection with materials offered through it.
THE INFORMATION IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THE WARRANTY OF NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY APPLICABLE LAW.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SARA MAHDAVI LLC AND ITS SUBSIDIARIES, AFFILIATES, MEMBERS, MANAGERS, AGENTS, OFFICERS, DIRECTORS, EMPLOYEES, OR PARTNERS SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE OUR WEBSITE OR ITS CONTENT, OR MATERIALS REQUESTED THROUGH EMAIL; THE STATEMENTS OR ACTIONS OF ANY THIRD PARTY ON OR THROUGH OUR WEBSITE; DEALINGS WITH VENDORS OR OTHER THIRD PARTIES; UNAUTHORIZED ACCESS TO OR ALTERATION OF TRANSMISSIONS OR DATA; INFORMATION THAT IS SENT OR RECEIVED OR NOT SENT OR RECEIVED; FAILURE TO STORE OR LOSS OF DATA, FILES, OR OTHER CONTENT; OR LOSS OF CLIENTS, GOODWILL, INCOME, REVENUE, ANTICIPATED INCOME, OR SALES.
We expressly exclude liability to the fullest extent permitted by law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or waives any nonwaivable consumer right. These provisions apply to Website use and do not replace the liability provisions of a separate client service agreement.

Indemnification
To the extent permitted by applicable law, you agree to defend, hold harmless, and indemnify Sara Mahdavi LLC and its subsidiaries, affiliates, members, managers, agents, officers, directors, employees, or partners from claims, demands, or causes of action, including reasonable attorney’s fees and costs, arising from your unlawful use of our Website or its content, your breach of these Terms, or third-party claims arising from content you submit or transmit through the Website.
If we are required to defend ourselves in an action arising from such conduct, you agree to reasonably cooperate by providing relevant documents, testimony, evidence, or other information. This section does not require indemnification for our own conduct where such an obligation is prohibited by law.

Prohibited conduct includes accessing data or accounts you are not authorized to access; probing or testing systems without authorization; interfering with service by transmitting viruses, flooding, spamming, or similar activity; using the Website to send unsolicited promotions; forging headers or impersonating another person; or attempting to modify, reverse engineer, decompile, or disassemble Website source code except where expressly permitted by law.
You understand that violations of system or network security may subject you to civil or criminal liability. Sara Mahdavi LLC may cooperate with law enforcement in investigating violations of these Terms or applicable law.

These Terms and Conditions shall be governed and construed according to the laws of the State of New York, without regard to conflict of laws principles.
Subject to nonwaivable rights under applicable law, the state and federal courts located in New York County, New York, shall have exclusive jurisdiction over disputes arising from your use of our Website or its content or related materials requested through email. You submit to the jurisdiction and venue of those courts and waive any defense of forum non conveniens to the extent permitted by applicable law.
In the event that Sara Mahdavi LLC must make a claim for a breach of these Terms by negotiation, litigation, mediation, or arbitration, we shall be entitled to recover reasonable attorney’s fees and costs to the extent permitted by applicable law. This provision does not itself require arbitration.

Severability
If any provision of these Terms and Conditions is declared unenforceable or invalid, all remaining provisions shall remain in full force and effect to the extent permitted by law.

Modification of Terms and Conditions
We reserve the right to change, modify, add, or delete portions of these Terms. Revisions will be posted on this page with an updated revision date, and we will provide any additional notice required by applicable law. Changes take effect upon posting unless otherwise stated.
